CivilSense is for situational awareness and analytical purposes only — not for emergency response. Do not rely on this platform to make life-safety decisions. Always follow guidance from official emergency management agencies (FEMA, NWS, state and local authorities). In an emergency, call 911.
1. Acceptance of Terms
By accessing or using any part of the CivilSense platform at civilsense.io ("Platform"), including the website, APIs, data feeds, and any associated documentation, operated by CivilSense, Inc., a Delaware corporation ("Company," "we," "us," "our"), you ("User," "you," "your") agree to be bound by these Terms of Service ("Terms"). If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.
If you do not agree to these Terms, do not access or use the Platform.
2. Description of Service
CivilSense provides real-time catastrophe intelligence, Climate-Adjusted Hazard Scores, consequence zone modeling, ILS (insurance-linked securities) trigger monitoring, and data analytics for the United States. The Platform ingests data from public government sources (USGS, NOAA, NASA FIRMS, FEMA, NIFC, NOAA SPC, IBTrACS) and applies modeling algorithms calibrated to peer-reviewed research to produce hazard assessments, consequence zone estimates, and AI-generated situation reports.

3. Important Disclaimers
3.1 Not Emergency Response Guidance
The Platform is designed for situational awareness and analytical purposes only. It is not a substitute for official emergency alerts, evacuation orders, or guidance from FEMA, the National Weather Service, or local emergency management agencies. CivilSense does not issue warnings, watches, or evacuation orders. In an emergency, call 911 and follow official directives.
3.2 Not Actuarial Work Product
Climate-Adjusted Hazard Scores, consequence zone estimates, exceedance probability curves, annual average loss estimates, and all other modeling outputs are derived from public data sources and published academic research. They are informational tools for screening and situational awareness. They are not a substitute for:
- Professional actuarial assessment or rate filing
- Property inspection or structural engineering evaluation
- Insurance underwriting decisions, coverage determinations, or claims adjustment
- Regulatory compliance analysis
Do not make insurance coverage, pricing, claims, reinsurance, or ILS structuring decisions based solely on CivilSense outputs. All outputs should be independently validated by qualified professionals.
3.3 Consequence Zone and Hazard Score Estimates
Zone estimates are based on scientific models and may differ from actual local conditions. Impact zones are approximations derived from historical data, physical models, and real-time sensor readings. Actual damage patterns depend on local geography, building construction, soil conditions, microclimates, and other factors not fully captured by any model. Hazard Scores represent physical intensity likelihood and do not include property exposure or vulnerability assessments unless explicitly labeled as "Risk Scores."
3.4 ILS Trigger Monitoring
Parametric trigger evaluations are informational only. They do not constitute a determination of whether a cat bond or ILS instrument has triggered. Actual trigger determination is governed by the instrument's legal documentation (offering circular, trigger supplement) and the designated calculation agent. CivilSense is not a calculation agent, reporting agent, or trustee for any ILS instrument.
3.5 AI-Generated Content
AI-generated situation reports (sitreps) are produced by large language models using publicly available data. They may contain inaccuracies, omissions, or outdated information. AI outputs are provided for convenience and must be verified against official agency communications and primary sources before any reliance.
3.6 OSINT Content
Open-source intelligence items (news articles, media, social posts) are aggregated from third-party sources. We apply credibility scoring and content moderation but do not guarantee the accuracy, completeness, or timeliness of third-party content. Third-party content is subject to its original publisher's terms and copyright.
3.7 OASIS LMF Output
Data formatted in OASIS Loss Modelling Framework format is provided for integration convenience. CivilSense is not certified by, endorsed by, or affiliated with the OASIS Loss Modelling Framework Foundation. Users are responsible for validating OASIS-formatted output against their own system requirements.
4. Data Sources and Attribution
CivilSense aggregates and derives analytical products from the following public sources:
- USGS — Earthquake feeds, National Seismic Hazard Model, ComCat catalog, Quaternary Fault Database
- NOAA — National Hurricane Center (NHC), Storm Prediction Center (SPC), Advanced Hydrologic Prediction Service (AHPS), SLOSH storm surge model, Storm Events Database, IBTrACS
- NASA FIRMS — VIIRS satellite-detected wildfire hotspots
- NIFC — National Interagency Fire Center wildfire perimeters
- FEMA — Disaster declarations, Hazus methodology (v6.1+), National Flood Hazard Layer, NFIP aggregate claims data
- USACE — Economic Guidance Memorandum 01-03 depth-damage functions
- GDELT — Global news aggregation for OSINT
All source data remains the property of the respective agencies. CivilSense derives analytical products from these sources but does not claim ownership of underlying government data. Our scoring methodology, model parameters, and analytical algorithms are publicly documented.
5. User Accounts and Subscriptions
5.1 Account Creation
You may create an account using a valid email address via magic link authentication. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must promptly notify us at security@civilsense.io if you suspect unauthorized access.
5.2 Subscription Billing
Paid subscriptions (Pro, Enterprise) are billed monthly via Stripe. All fees are stated in US dollars and are non-refundable except as required by applicable law. You may cancel at any time; access continues through the end of the current billing period. No pro-rated refunds are provided for partial billing periods.
5.3 Tier Changes
Upgrading takes effect immediately and is pro-rated. Downgrading takes effect at the end of the current billing period. If you downgrade, features exceeding your new tier's limits (e.g., saved locations, portfolio size, ILS triggers) will become read-only until reduced to within limits.
5.4 Enterprise Agreements
Enterprise subscribers may be subject to a separate Master Services Agreement (MSA) that supersedes these Terms where conflicts exist. Enterprise agreements include a Data Processing Agreement (DPA) upon request.
6. Acceptable Use
You agree not to:
- Use the Platform to issue false emergency warnings, fabricated disaster alerts, or misinformation that could endanger public safety
- Redistribute, resell, or sublicense Platform data, API output, hazard scores, or analytical products to third parties without written consent
- Use Platform data to build a competing catastrophe intelligence, hazard scoring, or ILS monitoring product
- Circumvent rate limits, authentication, or access controls
- Share API keys or access credentials with unauthorized parties
- Scrape, crawl, or bulk-download data beyond your tier's API allowance
- Submit false OSINT reports or abuse the content flagging system
- Reverse engineer, decompile, or attempt to extract source code, scoring algorithms, or model parameters beyond what is publicly documented
- Use the Platform in violation of any applicable law, including US export controls
7. API Terms
This section applies to users with API access (Enterprise tier and any tier with API access enabled).
7.1 API Keys
API keys are confidential credentials. Do not embed them in client-side code, public repositories, or shared environments. We reserve the right to revoke API keys that are compromised, shared, or used in violation of these Terms without prior notice.
7.2 Rate Limits and Quotas
Rate limits are enforced per tier and may be adjusted with 30 days' written notice. Exceeding rate limits will result in HTTP 429 responses. Persistent abuse may result in key revocation or account suspension.
7.3 Data Use Restrictions
API output may be used in your internal business operations, internal reports, and internal analytical workflows. You may display CivilSense data in your own applications provided you include the attribution: "Data: CivilSense (civilsense.io)." You may not:
- Resell or redistribute raw API output as a standalone data product
- Cache API responses for longer than the TTL specified in response headers
- Use API data to train machine learning models or build derivative datasets for distribution
- Remove or obscure data source attributions
7.4 API Availability
We target high API availability but do not guarantee specific uptime percentages outside of an MSA. Planned maintenance windows will be communicated via email. API SLAs with guaranteed uptime are available for Enterprise subscribers with MSA.
8. Intellectual Property
8.1 Platform IP
The Platform, including its scoring algorithms, modeling methodology, stochastic event sets, user interface design, documentation, and all associated intellectual property, is owned by CivilSense, Inc. and protected by US copyright and trade secret law.
8.2 Your Content
You retain ownership of data you upload (portfolio locations, saved addresses, ILS trigger configurations). By uploading, you grant us a limited license to process this data solely to provide Platform services to you. We will not use your uploaded data for any other purpose.
8.3 Output License
Analytical outputs generated for your account (hazard scores, sitreps, EP curves, trigger evaluations) are licensed for your internal business use. You may include CivilSense outputs in internal reports, presentations, and regulatory filings with attribution. Redistribution of outputs as a data product requires a separate licensing agreement.
8.4 Feedback
If you provide feedback, suggestions, or improvement ideas, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate that feedback without obligation.
9. Warranty Disclaimer
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that: (a) hazard scores, consequence zones, or other model outputs will be accurate, complete, or current; (b) the Platform will be uninterrupted, secure, or error-free; (c) data from third-party government sources will be accurate or available; (d) ILS trigger evaluations will match determinations made by designated calculation agents.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CIVILSENSE, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR USE OF OR INABILITY TO USE THE PLATFORM
- ANY ERRORS, INACCURACIES, OR OMISSIONS IN HAZARD SCORES, CONSEQUENCE ZONES, TRIGGER EVALUATIONS, EP CURVES, OR AI-GENERATED CONTENT
- DECISIONS MADE BASED ON PLATFORM DATA, INCLUDING BUT NOT LIMITED TO INSURANCE UNDERWRITING, REINSURANCE PLACEMENT, ILS STRUCTURING, EMERGENCY RESPONSE, EVACUATION, OR PROPERTY PURCHASE DECISIONS
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
- ANY INTERRUPTION, DELAY, OR CESSATION OF THE PLATFORM
- FAILURE OF THE PLATFORM TO DETECT, PREDICT, OR ACCURATELY MODEL ANY NATURAL DISASTER, CATASTROPHE, OR WEATHER EVENT
IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED THE GREATER OF (A) THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless CivilSense, Inc. and its officers, directors, employees, agents, successors, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Platform
- Your violation of these Terms
- Your use of Platform data for life-safety, emergency response, or actuarial decisions without independent professional validation
- Your redistribution of Platform data in violation of Section 7.3
- Any claim by a third party arising from your use of Platform outputs
For Enterprise subscribers with an MSA: indemnification terms in the MSA supersede this section. Indemnification obligations shall not exceed $100,000 for any individual claim unless otherwise specified in a separate agreement, except for claims arising from willful misconduct, gross negligence, or violations of Section 6 (Acceptable Use).
12. Termination
12.1 By You
You may cancel your subscription at any time through the Platform or by contacting support@civilsense.io. You may delete your account and request deletion of all associated data. Upon cancellation, paid access continues through the end of the current billing period.
12.2 By Us
We may suspend or terminate your access immediately and without prior notice for: (a) violation of Section 6 (Acceptable Use); (b) non-payment after 15 days' written notice; (c) API key compromise or sharing; (d) use of the Platform that poses a risk to public safety. For all other violations, we will provide 30 days' written notice and opportunity to cure before termination.
12.3 Effect of Termination
Upon termination: (a) your right to access the Platform ceases; (b) you must cease all API usage and destroy cached data; (c) we will delete your account data within 30 days, subject to legal retention requirements; (d) Sections 3, 8, 9, 10, 11, 14, 15, and 16 survive termination.
13. Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. Any permitted assignee shall be bound by these Terms.
14. Dispute Resolution
14.1 Informal Resolution
Before filing any formal proceeding, you agree to attempt to resolve disputes informally by contacting legal@civilsense.io. We will attempt to resolve the dispute within 30 days.
14.2 Binding Arbitration
If informal resolution fails, all disputes arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. Arbitration shall be conducted in Wilmington, Delaware, before a single arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
14.3 Class Action Waiver
YOU AND CIVILSENSE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
14.4 Exceptions
Either party may seek injunctive relief in any court of competent jurisdiction for claims related to intellectual property infringement, confidentiality breaches, or unauthorized data access.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. To the extent that arbitration does not apply, the exclusive jurisdiction and venue for any action shall be the state or federal courts located in Wilmington, Delaware.
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy and any applicable MSA, constitute the entire agreement between you and CivilSense, Inc. regarding the Platform.
16.2 Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
16.4 Force Majeure
Neither party shall be liable for failure or delay in performance due to causes beyond its reasonable control, including natural disasters, acts of government, internet or infrastructure failures, third-party data source outages, cyberattacks, pandemics, or acts of war.
16.5 Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and cancel your subscription.
16.6 Export Compliance
You represent that you are not located in, under the control of, or a national or resident of any country subject to US trade sanctions. You will not export or re-export Platform data in violation of US export control laws.
